On October 17, 2018, Canada became the first industrialized country to legalize recreational cannabis use. Now that it has been over a year since this historic development, we’ll explore how legal cannabis has left its mark on the p&c insurance industry, and what we can expect in the future. This includes a review of how the regulatory landscape has shifted across all levels of government.

As part of this review, we’ll examine new and emerging cannabis exposures in a variety of settings, including:

  • Automobile liability (including implications of legislation, state of technology for testing, roadside test pilot, new drug impaired offences)

  • Social and commercial host liability (including cannabis-related impairment, development of common law negligence)

  • Personal lines underwriting (including medical users and non-medical users, human rights considerations)

  • Commercial lines underwriting (including commercial property and claims considerations)

We’ll also look at new developments in commercial insurance and take an in depth review of the following coverages available, including:

  • Dispensary insurance

  • Cultivation insurance

  • Manufacturing insurance

  • Laboratory insurance

  • Product liability

  • Professional liability
