Water damage is the most common type of loss in our
industry, and when the loss includes a strata unit, it can involve multiple
parties and policies.
So, where do you start with a water
damage claim in strata?
This seminar will begin with an
explanation of the legal principles in respect to the obligations to repair, the
duty to insure, and how they relate to each other in the context of BC
legislation. The remainder of this seminar will be an interactive workshop
providing attendees the opportunity to review water damage scenarios and
determine liability.
SEMINAR OBJECTIVES
Examine the steps involved in a water damage claim, from incident to assessment and response, leading to repairs
Compare the strata corporation's duty to repair versus the owner's duty to repair
Engage in group discussions and work through scenarios to identify the party liable to pay the deductible and the party responsible for repairs when the damage is below or above the deductible

Veronica Franco , Partner - Clark Wilson LLP, Chair - Strata Property Practice
Group
Veronica is the Chair of Clark Wilson LLP’s
Strata Property Practice Group. She leads a group of litigators and solicitors
who primarily act for strata corporations on all aspects of strata governance as
well as other legislation affecting strata corporations. Her mandate is to help
strata corporations and property managers identify and address issues before
they become problems. She is a leader in the practice of strata law in BC and
one of the top contributors to advancing education within the industry,
presenting annual seminars for various industry groups including the Condominium
Home Owners Association, the Professional Association of Managing Agents, and
the Canadian Condominium Institute.
Adrienne Murray, Associate Counsel,
Hammerberg Lawyers LLP
Adrienne was the former
Deputy Superintendent of Real Estate for British Columbia and assisted with the
drafting of the Strata Property Act and continues to provide input on
legislative amendments that impact strata corporations and strata management
companies. Adrienne has practiced strata law since leaving the provincial
government in 2002 and provides advice to strata corporations and owners
regarding a wide range of strata issues including bylaw drafting and
enforcement, governance disputes and strata fee collections.
Jennifer Neville, Associate - Hammerberg Lawyers
LLP
Jennifer assists clients with bylaw and resolution drafting,
governance and compliance with the Strata Property Act, strata financing,
repairs, collections, and disputes. She regularly attends Special and Annual
General Meetings, and provides opinion letters regarding the Strata Property
Act.
