On October 17, 2018, Canada became the first industrialized country to legalize recreational cannabis use. On the first anniversary of this historic development, we’ll explore how legal cannabis has left its mark on the p&c insurance industry, and what we can expect in the future. This includes a review of how the regulatory landscape has shifted across all levels of government in the past 365 days.

As part of this review, we’ll examine new and emerging cannabis exposures in a variety of settings, including:

  • Automobile liability (including implications of legislation, state of technology for testing, roadside test pilot, new drug impaired offences)

  • Social and commercial host liability (including cannabis-related impairment, development of common law negligence)

  • Personal lines underwriting (including medical users and non-medical users, human rights considerations)

  • Commercial lines underwriting (including commercial property and claims considerations)

We’ll also look at new developments in commercial insurance and the new coverages available, including:

  • Dispensary insurance

  • Cultivation insurance

  • Manufacturing insurance

  • Laboratory insurance

  • Product liability

  • Professional liability
